Welcome to Own Your Wellness. These Terms and Conditions ("Terms") govern your access to and use of the website ownyourwellness.store (the "Site") and the purchase of any products offered through it. By browsing the Site, creating an order or completing a purchase, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or place an order.

1. Who we are

2. Eligibility

To place an order you must be at least 18 years old and have the legal capacity to enter into a binding contract. By ordering, you confirm that the information you provide is accurate and complete and that you are purchasing as a consumer for personal, non-commercial use unless otherwise agreed in writing.

3. Products and pricing

We sell general wellness and comfort products, including the Comfort Neck Brace, a cervical support made from high-density foam with a breathable mesh top. It is latex-free, adjustable from 28 to 51 cm and available in Gray, Black and Red.

All prices are shown in euros (EUR) and include applicable taxes unless stated otherwise. The Comfort Neck Brace is priced at 39,99 €. Shipping costs, where applicable, are shown before you confirm your order. We may run seasonal promotions, discounts or limited-time offers; these are valid only for the period and under the conditions stated, cannot be combined unless expressly indicated, and do not apply retroactively to previous orders. We make every effort to display accurate prices and product information, but errors may occasionally occur; where a clear pricing error is identified, we reserve the right to cancel affected orders and refund any amount paid.

4. Orders and payment

By submitting an order you make an offer to purchase the selected products subject to these Terms. Your order is accepted, and the contract formed, when we send you an order or dispatch confirmation. We reserve the right to refuse or cancel any order, for example in cases of suspected fraud, unavailability of stock or a pricing error.

Payment is required at the time of ordering through the payment methods offered at checkout. You confirm that you are authorised to use the chosen payment method. All payments are processed securely by our payment providers; we do not store full card details.

5. Shipping and returns

Orders are generally dispatched within 24 to 48 hours, and we offer free shipping on eligible orders. Delivery times and any applicable conditions are described in our Shipping Policy. You may also return your purchase under our voluntary 30-day money-back return, as described in our Returns Policy. Please review those policies, which form part of these Terms.

6. Right of withdrawal (14 days)

If you are a consumer resident in the European Union, you have the legal right to withdraw from your purchase within 14 calendar days from the day on which you, or a third party indicated by you, acquire physical possession of the goods, without giving any reason. This statutory right of withdrawal is granted under Directive 2011/83/EU and the Spanish consolidated Consumer Protection Act (Real Decreto Legislativo 1/2007, TRLGDCU).

To exercise your right of withdrawal, you must inform us of your decision before the 14-day period expires by sending a clear statement to hola@ownyourwellness.store. A model withdrawal form is available on request. We will confirm receipt of your request.

We will reimburse all payments received from you, including the standard delivery costs, without undue delay and no later than 14 days from the day we are informed of your decision to withdraw. We will use the same means of payment you used for the initial transaction, and you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having returned them, whichever is earliest. You are responsible for returning the goods without undue delay and may be responsible for the direct cost of returning them.

This statutory right of withdrawal is separate from, and additional to, our voluntary 30-day money-back return. The voluntary return is a commercial goodwill policy and does not limit, replace or override your statutory rights as a consumer.

7. Intellectual property

All content on the Site, including text, graphics, logos, images, product descriptions and the Own Your Wellness name and branding, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify or commercially exploit any content without our prior written permission.

8. Acceptable use

You agree to use the Site lawfully and not to: use it for any fraudulent or unlawful purpose; attempt to gain unauthorised access to the Site or its systems; introduce viruses or harmful code; interfere with the proper functioning of the Site; or infringe the rights of others. We may suspend or restrict access if we reasonably believe these Terms have been breached.

9. Health and product disclaimer

The Comfort Neck Brace is a general wellness and comfort product made from high-density foam. It is not a medical device and is not intended to diagnose, treat, cure or prevent any illness, injury or medical condition. Nothing on the Site constitutes medical advice.

If you have a pre-existing condition, are experiencing pain, or have any concerns about whether the product is suitable for you, consult a qualified healthcare professional before use. Use the product as intended and discontinue use if you experience discomfort.

10. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental or consequential loss arising from the use of the Site or the products. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for your non-waivable statutory rights as a consumer. Our total liability in connection with any order shall not exceed the amount paid for that order, except where mandatory law provides otherwise.

11. Indemnity

You agree to indemnify and hold harmless Own Your Wellness and [Legal company name] against any claims, losses or reasonable costs arising from your breach of these Terms or your unlawful use of the Site, to the extent permitted by applicable law and except to the extent such claims result from our own negligence or breach.

12. Changes to these Terms

We may update these Terms from time to time to reflect changes in our products, practices or legal requirements. The version in force at the time you place an order applies to that order. We encourage you to review these Terms periodically; the effective date above indicates when the current version took effect.

13. Governing law and jurisdiction

These Terms are governed by the laws of Spain and applicable European Union regulations. Any dispute shall be subject to the competent courts of Spain. If you are a consumer, this does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.

14. Dispute resolution

If you have a complaint, please contact us first at hola@ownyourwellness.store so we can try to resolve it directly. As a consumer, you may also submit your claim to the Spanish consumer arbitration system (Sistema Arbitral de Consumo) through the relevant Junta Arbitral de Consumo, or refer the matter to the competent consumer authorities and courts in Spain.
